U.S. court finds in favour of Ariba
Emptoris has been ordered to pay damages of around $7m to Ariba after a US District Court found that the company had infringed two reverse-auction patents.
The court, in the Eastern District of Texas, also ruled that Emptoris must pay Ariba pre-judgement interest on the original pre-enhancement damage award, made in October 2008.
An injunction is expected to be issued by the courts against Emptoris preventing it from infringing the patents later this month.
Speaking after the judgement, David Middler, senior vice president and general counsel of Ariba, said: “This ruling and the judge’s statements are further testament to the strength of Ariba’s intellectual property and our ability to deliver innovations in electronic auctions and sourcing.
“Ariba will continue to offer the functionality covered by these two patents as part of its sourcing solutions.”
